Legal Affairs Office of the People's Government of Beijing Municipality

Legal Affairs Office of the Ppeople's Government of Beijing Municipality has the following main responsibilities:

1. Make plans for the municipal government's legislative work; draft administrative regulations to be released in the name of the municipal government and make project plans and annual plans for the submission of local rules and regulations to the municipal people's congress for deliberation; and oversee the implementation of these rules and regulations after their approval by the municipal government.

2. Promote law-based administration, guide municipal government agencies and county and township governments in legislative work; and enforcemonitor and inspect the enforcement of relevant rules and regulations related to law-based administration.

3. Provide legal opinions to the municipal government on important decisions; make proposals or suggestions on the implementation of important national laws, rules and regulations in the city; implementstudy the implementation of laws, administrative regulations and rules pertaining to the common code of practice of the government, as well as common problems in administrative law enforcement, so as to recommend to the municipal government amendmentts and solutions.

4. Review and approve drafts of local rules and regulations submitted by municipal government agencies to the municipal government; draft or organize the drafting of important local laws, regulations and rules; offer interpretations on regulations and rules, and on their application where the municipal government is so required by local rules and regulations; solicit opinions on drafts of national laws and administrative laws and regulations.

5. Examine and confirm the qualifications of administrative law enforcement agencies.

6. Handle cases of administrative reviews and administrative compensation; mediate disputes over jurisdiction over administrative reviews; serve as respondent in administrative lawsuits against the municipal government; review administrative punishment decisions and hold hearings on major administrative punishments decided on by the municipal government if so required by the municipal government; operate the database of cases of administrative punishment, administrative reviews, administrative compensation and administrative litigation.

7. Put on record administrative measures and regulatory documents adopted by district and county governments and municipal government agencies and offer opinions after review.

8. Supervise administrative law enforcement and mediate disputes over law implementation among municipal government agencies.

9. Organize and provide guidance to administrative law enforcement personnel.

10. Publish, review and compile rules and regulations of the municipal government; compile local rules and regulations; organize, examine and revise the translations of municipal government regulations.

11. Carry out study and exchanges on legal theories and government's legal affairs work; manage the database of local rules and regulations; and organize outward exchanges on legal affairs.

12. Undertake other work assigned by the municipal government.
