Guide to Adoption in Beijing

At present there are 17 countries that have established cooperative relationships with China in inter-country adoption. Only citizens of these countries can adopt children from China.

How do foreign adopters apply for adoption notary?

According to the Measures of Registration of Adoption of Chinese Children by Foreigners in the PRC, the foreign adopters should go to the local notary agencies of the registration agencies to undergo adoption notary if either the adoptee or the adopters propose the demand. What kinds of fees should be paid for the foreign adoption application?

Foreign adopters who come to China to adopt Chinese children should pay the China Adoption Affairs Office service fees, registration agency registration fees, and passports and notarization fees. What are the limitations to those foreign adopters with children?

The China Adoption Affairs Office will take precedence to arrange adoptees to adoptive families with less than two kids. For those adoptive families with five or more children living with them, the China Adoption Affairs Office will usually not arrange any adoptee to their families.

How many Chinese children can be adopted by one foreign adopter at a time?

Normally, one foreign adopter can adopt one Chinese child at a time (but there are exceptions for twins or siblings at the same welfare agencies). If foreign adopters who have already adopted one Chinese child want to adopt more Chinese children, they have to submit adoptive materials again one year later. Can the foreign adopters with criminal punishments adopt Chinese children?

It is very important to investigate whether foreign adopters have any criminal punishments. The China Adoption Affairs Office will usually not accept applications of foreign adopters with criminal punishments. There are reasonable exceptions for those foreign adopters with misdemeanors, better repentance performances, and who have no recidivisms for a very long time.

What kinds of conditions will lead a foreign adoption application to a "quicker adoption"?

Apply to adopt an adoptee living in a social welfare institution;

Foreign adopters under 45 years old applying to adopt an adoptee under 3 years old living in a social welfare institution;

Foreign adopters over 45 years old applying to adopt an adoptee over 6 years old living in a social welfare institution;

Adopting an adoptee with special needs recommended by the China Adoption Affairs Office;

If both or either of the adoptive parents are overseas Chinese;

If the adopters have been working or studying in China more than a year;

If the foreign adopters want a quicker adoption process, they have to submit a written application for a quicker adoption process to the China Adoption Affairs Office through local government or the government commissioned adoptive institutions. How does the China Adoptive Affairs Office accept applications from foreign adopters?

After receiving the adoptive materials, the China Adoptive Affairs Office will register the application with comprehensive adoptive materials and receipts of services fees. The office will send a written notice of accepted conditions to related adoptive governments and organizations within 30 days.

Can single foreigners adopt Chinese children?

Single foreign adopters can not adopt Chinese children unless they meet the conditions mentioned in the Adoption Laws. In accordance with the principle that "the adoption should benefit the growth of the minor adoptee", it is better for the adoptee to live with parents in a sound adoptive family. Therefore, the China Adoption Affairs Center will usually select foreign adoptive families with parents to be the adoptive targets instead of single adopters.

How do the foreign adopters apply for the suspension of adoption?

The foreign adopters, who apply for the suspension of adoption processes, should submit written notice to the China Adoption Affairs Center through the local government or adoption organization. The adoption process can be suspended a maximum of 12 months. If the suspension lasts over 12 months, the application will be withdrawn.

How can the adoptee apply for the termination of adoption?

When the adoptee applies for the termination of adoption, they have to offer written notice to the China Adoption Affairs Center through the local government or the adoption organization. The written notice should show the name of the adoptee, the time of application, the reason for the termination, the account and title of the adoption organization and the autograph of the head of the adoption organization or the autograph of the department heads. After receiving the application, the China Adoption Affairs Center will return the adoption materials of the foreign adopters to the local government or the adoption organization and return some of the service fees in accordance with the specific circumstances of operation in the China Adoption Affairs Center.

How does the adoptee go through exit formalities?

According to the Measures of Registration of Adoption of Chinese Children by Foreigners in the PRC, the adopter should take the Adoption Registration Certificate to the local public security organs to prepare the exit formalities for the adoptee before the exit.

What is the submission process for Post Placement Reports to the China Adoption Affairs Center?

No matter whether the adoptee joins the nationality of the Adopter, the China Adoption Affairs Center will require the adoption organization to turn in two Post Placement Reports in the first year of adoption, one report every six months. If the adoptee doesn't join the nationality of the adopter, the adoption organization will continue the submission of Post Placement Reports every six months until the adoptee joins the nationality of the adopter.
