I would say texting on a cell phone should be banned, but not talking. I don't see any difference between talking on your phone as opposed to talking to someone in the car, singing along with the radio, gesturing to other drivers or all the other distracting things I see people doing while they drive. As with anything involving human behavior, you can regulate, ban or limit the use of something, but we will always find another way and that you can't fix.
