Provisional Measures on the Offshore Duty-Free Shopping Supervision of Customs in Hainan Province

Chapter 1: General Provisions
Article 1
For the purpose of regulating the offshore duty-free shopping supervision of Customs in Hainan province and promoting the development of Hainan provincial tourism industry, these provisional measures have been formulated under the authorization of the State Council.
Article 2
These provisional regulations is applicable to the offshore passengers who have made the payment for the duty-free goods in the duty-free stores (abbreviated below as DFS), taking the delivery of the duty-free goods at the pick-up counters in the domestic quarantine zones of Hainan’s airports, and taking flights to leave the island with all of the goods in one lump sum, under the supervision of Customs.
Article 3
The DFS shall set up pick-up counters within the domestic quarantine zones and report to Customs for approval.
The quarantine zones and the pick-up counters are subject to supervising and managing of Customs, and their supervision and management should comply with the requirement of Customs.
Article 4
The offshore passengers shall make the purchase of the duty-free goods in accordance with the stipulations on number of times, values, quantities, and categories. Beyond these specifications, the DFS is not allowed to sell.
Chapter 2: Sale, delivery and pick-up of the duty-free goods
Article 5
Each passenger living on Hainan island can enjoy the offshore duty-free shopping policy only once per person a year according to the Gregorian calendar. Each passenger who does not reside on the island can enjoy the policy only twice a year.
The status of the domestic passengers living on the island or not will be identified by Customs in accordance with the certificate issued by ID card organ. The status of the overseas passengers will be approved according to the valid entry and exit certificate.
Article 6
While setting accounts in the duty-free stores, the offshore passengers shall take the initiative to show their own effective certificates, and provide the information of the flights they take to leave the island as well as the detailed information of their purchased commodities.
Article 7
Each offshore passengers is allowed to spend no more than 5,000 yuan ($768) in total on the duty-free shopping one time. For details about the quantity and scope of a single species that an offshore passenger can purchase each time, please refer to the appendix.
Each passenger is allowed to purchase one more piece of article worth more than 5,000 yuan one time on condition that he or she pays import duties for imported goods in full payment.
After shopping the duty-free goods and leaving the island by air, the passenger will be recorded as having experienced one duty-free shopping.
Article 8
The Customs will levy the duty on the offshore passenger who makes a purchase of the duty-free goods worth more than 5,000 yuan per unit in accordance with the duty-paid price set by the stipulations.
The offshore passenger may declare to Customs for the duty payment formalities through the DFS.
