Q: What issues should be noted in the process of trademark licensing?
A: According to Article 26 of Trademark Law, a trademark registrant may by concluding a trademark-licensing contract, authorize another person to use its registered trademark. The trademark licensing plays an important role in realizing the trademark right. The following issues should be noted:
1. The licensed trademark must be the registered trademark, and licensor should be the registrant;
2. The scope of commodities or service licensed to the licensee should be no more than the scope as shown in the Registration Certificate; 3. The name of the licensee and the origin of the goods must be indicated on the goods that bear the registered trademark; 4. Details on how to use the name, the type of licensing, the period of licensing, and the quantity should be stipulated in the license agreement; 5. The licensor would supervise the quality of the goods on which the licensee used the licensor’s registered mark and the licensee would guarantee the quality of the goods on which the registered trademark was to be used.
