36% do not get paid for holiday overtime

About 35.7 percent out of 2,054 respondents said they never got paid for overtime work on holidays, compared with only 23.7 percent who were paid for every holiday, China Youth Daily reported Tuesday.

The data is based on an online survey conducted by the Social Survey Center of China Youth Daily. It also shows that 21.8 percent of the respondents had frequent holiday overtime and 14.4 percent never had that.

Failing to get paid for holiday overtime is usual, said a citizen surnamed Chen in East China's Jiangsu province. He said his daughter's work on weekends was never counted as overtime, let alone getting paid for holiday overtime.

According to China's Labor Law, workers should be paid for overtime on public holidays and the pay could be no less than three times the normal rate. The holidays are the New Year's Day, the Spring Festival, International Workers' Day, the National Day holiday and other public holidays.

However, 34.3 percent of the respondents said there was bad implementation of the rule.
