State-Owned Assets Supervision and Administration Commission

With approval of The Program for the Reform of the Institutions of the People's Government of Beijing Municipality by the Central Committee of the Communist Party of China and the State Council, and according to the Notice of the People's Government of Beijing Municipality about the Establishment of Institutions (No. 18 (2003) of the People's Government of Beijing Municipality), the State-Owned Assets Supervision and Administration Commission of the People's Government of Beijing Municipality was established as a bureau level organ specially set up and under the people's government of the Beijing Municipality. Authorized by the municipal government, it shall fulfill duties of state-owned assets investor on its behalf. Decided by the Communist Party of China Beijing Municipal Committee, CPC committee of State-Owned Assets Supervision and Administration Commission of the People's Government of Beijing Municipality was established to fulfill duties as regulated by CPC Beijing Municipal Committee. The State-Owned Assets Supervision and Administration Commission of the People's Government of Beijing Municipality supervises and administrates the state-owned assets invested in enterprises by the municipal government.

Its main duties are:

1.To fulfill duties of state-owned assets investor with authorization of the Beijing Municipal Government and under the Company Law of the People's Republic of China, and Interim Regulations on the Supervision and Administration of State-Owned Assets of Enterprises; to promote reforms and reorganization of state-owned and state-controlled enterprises; to supervise value preservation and increment of the state-owned assets in enterprises, and to enhance the enterprises' management on state-owned assets; to instruct state-owned and state-controlled enterprises to establish a modern enterprise system, and to improve the administration structure; to promote the strategic adjustment on the distribution and structure of the state-owned economy; to boost mixed-ownership economy with state-owned, collective, and non public-owned capital, all involved in share holding, and to make the share holding system the main form of public ownership

2.To send Boards of Supervisors to invested enterprises on behalf of the municipal government according to related regulations, and work on daily administration of the Boards;

3.To appoint, examine, honor or punish principals of enterprises through legal procedures according to their performance; to establish an employment mechanism, which conforms with the socialist market economy and modern enterprise system, and improve incentive and restraint mechanism for management;

4.To supervise value preservation and increment of state-owned assets in enterprises by statistics and auditing; to establish and improve value preservation and increment of the state-owned assets indicator system, make criteria for examinations, and safeguard the rights and interests of the state-owned assets investor;

5.To supervise state-owned assets in institutional units that implement enterprise management;

6.To draft local laws, regulations on state-owned assets management; to supervise state-owned assets management of district and county divisions;

7.To work on additional items as assigned by the municipal government.
