法官、检察官惩戒制度(fàguan jiǎncháguān chéngjiè zhìdù): Disciplinary system for judges and procurators
The Supreme People's Court and the Supreme People's Procuratorate have jointly issued a document on establishing a disciplinary system for judges and prosecutors.
Disciplinary committees will be established at the provincial level to deal with judges and prosecutors that violate the rules when dealing with legal cases.
Those who intentionally violate the rules will be dealt with by the people's court and the people's procuratorate according to the related regulations.
The judiciary is the last defense of social justice. A sound and effective disciplinary system is key to guaranteeing judges and prosecutors perform their duties as they should and prevent corruption, so that people can see justice being done in all cases.
For a long time China has lacked an independent disciplinary system for judges and prosecutors. The new disciplinary system will help ensure a neutral and fair environment to deal with any misconduct by the judiciary. The disciplinary committees will consist of members of the people's congress and people's political consultative conference, legal experts, and representative lawyers, judges and procurators.
To ensure the committees fully play their role in regulating judges and prosecutors, the selection mechanism, working procedure and rules, power and responsibility of the committees should be clarified and transparent.
Supervision of the committees is also necessary to prevent them misusing their power.
