SPC news briefing introduces new provisions concerning prohibitory injunctions

The Supreme People’s Court (SPC) held a press conference on Dec13 in Beijing to announce new provisions concerning prohibitory injunctions in intellectual property disputes.

 

Hosted by SPC spokesman Lin Wenxue, the briefing was attended by Song Xiaoming, presiding judge of the SPC’s Civil Adjudication Tribunal No3 (IPR Division), and Wang Chuang, vice-presiding judge of the SPC’s Civil Adjudication Tribunal No 3 (IPR Division).

The new provisions on prohibitory injunctions in intellectual property disputes were issued on Nov 26 and will be effective on Jan 1, 2019. Aprohibitory injunction is a court order that stops one party from taking or continuing to take an action that negatively affects another party until the matter can be heard in court.

 

It is a critical provision to improve the injunction system and protect intellectual property and will have a positive influence on scientific innovation, cultural prosperity, operational integrity and healthy competition, said Song Xiaoming on the press conference.
