Regulations concerning the consumer’s claim for bodily damages caused by the free food provided by restaurants
In accordance with the relevant regulations of Law of the PRC on the Protection of the Rights and Interests of Consumers, in the purchase or use of commodities or receipt of services, consumers shall have the right to be free from damage to their personal and property safety. Consumers shall have the right to require those who run the business to provide commodities and services that meet the requirements for personal and property safety. Consumers whose legitimate rights and interests are infringed upon during the receipt of services can demand compensation from the providers of the services. In case the free food provided by restaurants is unhygienic or defective and causes personal damage to consumers, such as diarrhea, poisoning and so on, even if the food is free of charge, restaurants, as the providers of services, shall bear liability for compensation to consumers whose personal safety is infringed upon.
