Is the 'crime of group sex' really outdated?

Sociologist Li Yinhe, known for her promotion of "sex rights", has again become the focal point of public attention with an article that appeared in her blog on March 3.

Li wrote that the "crime of group sex" in the Chinese criminal law has been so outdated that it should be abolished. While the Internet was abuzz with the debate, 22 people including an associate professor were charged with the crime and being prosecuted by district prosecutors in Nanjing.

I've found it difficult to agree with her suggestion. Li has listed the following reasons for the abolishment of the crime.
