SHENZHEN – A Shenzhen-based enterprise has accused technology giant Apple of patent infringement on the iPad – a trademark both companies claim.
The Pudong district court in Shanghai will hear the case this month. An earlier suit, seeking to fine Apple 240 million yuan ($38 million), is pending in Beijing.
"We ask the court to stop selling and marketing for Apple’s iPad in China. We also demand an apology,” said Xie Xianghui, a lawyer representing the Proview Technology Shenzhen.
According to Xie, Proview Shenzhen Technology registered the iPad trademark in China in 2001. Proview Taiwan, which is affiliated with the Shenzhen company but did not legally represent it, sold the trademark to UK-based IP Application Development. The UK company then resold the rights to Apple, Xie said.
Apple sued Proview Shenzhen last year to gain legal acknowledgment of its right to the iPad name, but lost the lawsuit.
