The former Disney star previously told officials she wasn't driving her Porsche during the accident earlier this year, which involved colliding into the back of a truck on the Pacific Coast Highway, but after several witnesses claimed she was in fact behind the wheel the case is to be filed as a misdemeanour by the Santa Monica City Attorney, according to TMZ.com

The website also reports that police found pills in the trunk of Lindsay's car following the crash, but her lawyer Shawn Holley later provided valid documents to prove the medication was properly prescribed.

The 'Liz & Dick' star is still on probation after being found guilty of stealing a necklace in July 2011, for which she was sentenced to 120 days in prison and 480 hours of community service.

Other offences include Lindsay being arrested on suspicion of driving under the influence (DUI) in May 2007, resulting in her heading for rehab for 45 days, followed by her blood alcohol level being over the limit and cocaine found in her coat after she refused to take a sobriety test in June of that year.

Linday's first publicist Steve Honig quit working for the troubled star in October after a damaging few months for the actress, which also saw her accuse mother Dina Lohan of taking cocaine and foil an intervention attempt by her father Michael Lohan.

Steve claimed that every time Lindsay has been to rehab "she went in dirty and didn't come out clean".
