DA: Tom Sizemore should go to prison

LOS ANGELES - Prosecutors said Thursday they will ask a judge to revoke Tom Sizemore's probation and impose a sentence of 16 months in prison.

The 45-year-old actor has had a string of legal problems, the most recent coming this month, when he was arrested outside a hotel where police found two bags of suspected methamphetamine and smoking pipes in his car. He has pleaded not guilty to several drug-related charges.

Prosecutors said in court documents that in light of the actor's arrest, Sizemore should have his 36-month probation revoked.

Sizemore, who appeared in the movies "Saving Private Ryan" and "Black Hawk Down," was convicted of methamphetamine possession in October 2004.

His probation was revoked the following year after he acknowledged faking a drug test and failing to be checked for drugs every three days.

Probation was reinstated, but Sizemore faced another parole revocation and prison time after testing positive for drug use in early 2006. A judge gave him three years of probation, and Sizemore was ordered to submit to weekly drug tests.

Sizemore also was convicted in 2003 of domestic violence involving his ex-girlfriend, former Hollywood madam Heidi Fleiss. He had been free on bail pending an appeal in that case.

Details about Sizemore's May 8 arrest were included in the court filing. A police report alleged that the actor told investigators he had used methamphetamine the night before his arrest. It said he told police he had not used the drug since last May and called it a "disease."

A hearing is scheduled June 5.

A phone message left for Sizemore's attorney Gilbert Gaynor was not immediately returned.
